Sex Discrimination
Title VII of the Civil Rights Act of l964 prohibits employers from discriminating against individuals - in hiring, firing, and other terms and conditions of employment - because of their sex. Title VII also prohibits employment decisions based on stereotypes and assumptions about abilities, traits, or the performance of individuals on the basis of sex. This form of discrimination may be inadvertent or intentional, and it can be obvious or subtle; regardless, it is unacceptable at Appalachian and, in many cases, is against the law.
Title IX of the Education Amendments of 1972 protects people from discrimination based on sex in education programs or activities which receive federal financial assistance. Title IX states that:
No person in the United States shall, on the basis of sex, be excluded from participation in , be denied the benefits or, or be subjected to discrimination under any program or activity receiving federal financial assistance.
Definitions of Sex Discrimination:
Sex is the condition or character of being biologically male or female.
The EEOC is charged with the responsibility of education, research, investigation, and enforcement of Title VII. Specific EEOC guidelines on sex discrimination are available in the Code of Federal Regulations.
Examples of sex discrimination may include:
- A male employee is not granted a career opportunity because of his sex.
- A qualified female candidate is not offered a job solely because she is a woman.
- A professor permits other students to put down, demean, and ridicule a student because of his sex.
- A female candidate in a traditionally female-dominated career (e.g.,. primary education) is hired over an equally- qualified male.
It is also unlawful to retaliate against an individual for opposing employment practices that discriminate based on sex or for filing a discrimination charge, testifying, or participating in any way in an investigation, proceeding, or litigation under Title VII or Title IX..
